Insurance Violations of Insurance Code Section 21.21 Persons who are victims of unfair or deceptive insurance practices may have a cause of action under the DTPA, Article 21.21 of the Insurance Code, or both. The DTPA provides a cause of action for a consumer when the use or employment of an act or practice violates Article 21.21. Article 21.21 provides a cause of action for a person who has sustained actual damages caused by another's engaging in an act or practice (1) declared to be an unfair or deceptive practice under Section 4 of Article 21.21, or (2) specifically enumerated in the DTPA ``laundry list'' of violations as an unlawful deceptive trade practice. |
